Terms and conditions of use of the Corporate Carbon Database

1.Introduction

The Corporate Carbon Database is built, owned and operated by Corporate Carbon Data Ltd (CCD), 124 City Road, London, EC1V 2NX, United Kingdom.

Subscription users can not use the same login and password. In other words, it is required that each subscription user (from the same company at the same location) uses their own login and password (i.e. one different login and password per person) to access the Corporate Carbon Database.

CCD reserves the right to suspend or terminate your access and use of the website at any time for reasons of, but not limited to, maintenance or update of the website. CCD may exercise this right with or without notice. If applicable, notice will be given to your e-mail address as notified to CCD. In that event, notice will be deemed to be served three hours after transmission or posting.

2.Use of CCD Content

All content on this website belongs to Corporate Carbon Data Ltd (CCD) or its partners from whom CCD has received the authorisation to use it. You may retrieve and display content from the site on a computer screen, print individual pages on paper and store such pages in electronic form on disk for your personal use or for internal use within your company.

Reproduction of a part of the content (data, data tables, graphs) on a website or a newsletter is permitted, providing the source of the data (i.e. Corporate Carbon Data with a link to https://carbondata.world) is clearly indicated in the text and next to the tables and charts used. You may also use a copy of the screen of our data platform to share in your communications (newsletter, report, analysis brief, etc…), providing the source of the data (i.e. Corporate Carbon Data with a link to https://carbondata.world) is clearly indicated.

The full reproduction of our data on a website is prohibited.

The commercial redistribution of our PDF data reports is prohibited.

In any case, you may not remove the copyright or trade mark notice from any copies of the content made under these terms.

3.Confidentiality

Each user is responsible for the use of their right of access to CCD’s Corporate Carbon Database using their own login and password.

Each user is responsible for protecting and keeping secure their login and password from unauthorized use. The user must not disclose their login and password to any other party, whether internally or externally.

4.Privacy

The personal data that you provide us with will be incorporated into files belonging to CCD. These data will be used for customer administration, market studies, personalised information and promotional campaigns concerning our products and services, and products and services of our partners.

If you do not wish to receive this type of information please inform us to that effect by e-mail at info@carbondata.world . You have the right to inspect and, if necessary, correct your personal data.

We follow GDPR requirements regarding your data privacy.

5.Limitation of liability

The content is only for your general information and use and is not intended to address your particular requirements. We disclaim any and all loss or liability resulting from, but not limited to : (1) access delays or access interruptions; (2) data non-delivery or data mis-delivery; (3) force majeure; (4) the unauthorised use or misuse of your account number or password; (5) errors, omissions, or misstatements in any and all information or service(s) provided under this agreement; (6) our processing of your application for our services.

The website may contain links to other World Wide Websites, either directly or through frames and, where possible, we will make clear where such links are being made. Those sites are provided by independent third parties and CCD is not responsible for their availability or content

6.Indemnity

You agree to release, indemnify, and hold CCD harmless from all liabilities, claims, damages, costs and expenses, of third parties relating to, or arising under this agreement, the services or information provided hereunder or your use of our services or information, including without limitation infringement or dilution by you, or someone else using our service(s) or information from your computer, of any intellectual property or other proprietary right of any person or entity, or a violation of any of our conditions or policies relating to the service(s) or information provided.

7.Disclaimer of warranties

We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We make no warranty that our service(s) or information will meet your requirements, or that the service(s) or information will be provided uninterrupted, timely, secure, or error free; nor do we make any warranty as to the results that may be obtained from the use of the service(s) or information or as to the accuracy or reliability of any information obtained from the website. You understand and agree that any material and/or data downloaded or otherwise obtained from our website is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of such material and/or data. We make no warranty regarding any goods or services purchased or obtained through any of our services or any transactions entered into through such services. No advice or information, whether oral or written, obtained by you from us shall create any warranty not expressly made herein. 8.Return and refund policy

Since we supply intangible products (data platform subscriptions and pdf downloads), CCD does not offer any product return policy.

Likewise, since we provide non-tangible, digital goods, we do not issue automatic refunds for digital products once the order is confirmed and product is sent or data subscription is activated.  

The Consumer legislation of many countries gives you rights to claim against the seller if your digital download is faulty. As a seller, we can issue a refund if there is a technical problem and we can’t help you to resolve the matter or if there was a misrepresentation in the product description. In those cases, the refund period is 60 days from the moment of the purchase.

We consider a technical problem to be one of the following:

• Non-delivery of the product: due to some mailing issues of your e-mail provider or your own mail server, you might not receive a delivery email from us. In this case, we recommend contacting us for assistance.
• Major defects: although all the products are thoroughly tested before release, unexpected errors may occur. Such issues must be reported directly to our technical support.
• Product not-as-described: such issues must be reported to our technical support within 14 days from the date of the purchase. Clear evidence must be provided proving that the purchased product is not as it is described on the product description page. Complaints which are based merely on the customer’s false expectations or wishes are not honoured.

9.Changes to these terms

CCD reserves the right, at its discretion, to make changes to any part of the website. If you access the website and use the content and the services offered on the website after CCD has published the changed version on the website you are agreeing now to be bound by such new version. If you do not agree to be bound by those changes, you should not use the website any further.

10.Advertising and sponsorship

Part of the website may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the website complies with international and national law. CCD will not be responsible for any error or inaccuracy in advertising material.

11.General

You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.

If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.

Failure by either party to exercise any right or remedy under these Terms and Conditions does not constitute a waiver of that right or remedy.

Headings in these Terms and Conditions are for convenience only and will have no legal meaning or effect.
